Survey medical malpractice in Laser application in medical science refer to forensic medicine during 1395-1399 in Tehran, Iran

Introduction: Today, laser technology is an integral part of medicine, medical malpractice is a major problem in healthcare systems.the purpose of present study was investigation of common causes of injuries, claims, and decisions related to medical malpractice claims related to Laser-therapy. Methods: investigation of legal documents in the coroner’s Office of Forensic Medicine, province of Tehran, national database during 1395 to 1399. Frequency and nature of cases, including year of litigation, location and certification of provider, injury sustained, cause of legal action and judgment were investigated. Findings: From 1395 to 1399, more than three hundredths cases related to injury from laser-therapy was registered in the coroner’s Office of Forensic Medicine, province of Tehran. The incidence of litigation related to laser surgery shows an increasing trend, with peak occurrence in 1399. Laser hair removal was the most common litigated procedure (53.5%). General practice operators have the most legal negligent and after that ophthalmologist was the most frequently litigated against. The common reason of complainant was the lack of skill. Of the 314 cases of laser related legal claims, 203 (64.6%) resulted in decisions in favor of the plaintiff. Conclusions: Claims related to laser application in medical sciences are increasing. by surveillance and analysis of laser related legal claims, we can find the weakness point of laser in medical science and avoid probably injuries, enhance the quality of care, and improve patient safety
