چکیده

We study optimal patent design with sequential innovation. Firms innovate by undertaking “research” activities to generate new ideas and by undertaking “development” activities to transform these ideas into viable products. We characterize optimal patent policy, in particular, the tradeoff between patent length and breadth in this setting. We identify a “replacement effect” from the social planner’s perspective: for given reward size, a better patent that generates higher social surplus is shorter but broader. The optimal patent breadth is independent of whether the current patent is expired or not. The optimal patent length may be finite. ∗We thank Matthew Mitchell and Atle Seierstad for helpful comments, and Joaquin Poblete and Konstantinos Serfes for discussing the paper. Anticommons and optimal patent policy in a model of sequential innovation

When innovation is sequential, the development of new products depends on the access to previous discoveries. As a consequence the patent system affects both the revenues and the cost of the innovator. We construct a model of sequential innovation in which an innovator uses n patented inputs in R&D to invent a new product. We ask three questions: (i) what is the net effect of patents on innovat...

Patent Policy, Patent Pools, And The Accumulation Of Claims In Sequential Innovation

We present a dynamic model where the accumulation of patents generates an increasing number of claims on sequential innovation. We compare innovation activity under three regimes –patents, no-patents, and patent pools– and find that none of them can reach the first best. We find that the first best can be reached through a decentralized tax-subsidy mechanism, by which innovators receive a subsi...

Sequential Innovation , R & D Intensity , and Patent Policy

This paper studies optimal patent policy in a dynamic setting with sequential innovation. Firms innovate by undertaking “research” activities to generate new ideas and by undertaking “developement” activities to commercialize these ideas. To provide firms with incentive to invest in R&D, the social planner grants a monopoly right (patent) to an innovator to exclude its opponent from producing t...

Sequential innovation, patents, and imitation

We argue that when innovation is “sequential” (so that each successive invention builds in an essential way on its predecessors) and “complementary” (so that each potential innovator takes a different research line), patent protection is not as useful for encouraging innovation as in a static setting. Indeed, society and even inventors themselves may be better off without such protection. Furth...

Working Paper Department of Economics Sequential Innovation, Patents, and Imitation

How could such industries as software, semiconductors, and computers have been so innovative despite historically weak patent protection? We argue that if innovation is both sequential and complementary—as it certainly has been in those industries—competition can increase firms’ future profits thus offsetting short-term dissipation of rents. A simple model also shows that in such a dynamic indu...
