Photographs as Evidence ∗

چکیده
Photographs furnish evidence. This is true in both formal and informal contexts. The use of photographs as legal evidence goes back to the very earliest days of photography, and they have been used in American trials since around the time of the Civil War. Photographs may also serve as historical evidence (for example, about the Civil War). And they serve in informal contexts as evidence about all sorts of things, such as what we and our loved ones looked like in the past. Photographs are not, of course, the only sorts of pictures that can furnish evidence. It is not hard to think of cases in which a non-photographic picture might serve as legal evidence (perhaps of art theft?). Cave paintings serve as anthropological evidence of human habitation. And crude pictures chalked on the side of a building may serve informally as evidence of adolescent mischief. Nonetheless, photographs seem to have a distinctive epistemic status as compared with other sorts of pictures. Unlike the aforementioned examples of non-photographic depictions, photographs typically provide evidence specially about what they depict. Most significantly, the epistemically special character of photographs is revealed by this fact: we are inclined to trust them in a way that we are not inclined to trust even the most accurate of drawings and paintings. The traditional explanation for the special epistemic status of photography is that photography is an inherently realistic medium. This certainly sounds

Gruesome evidence and emotion: anger, blame, and jury decision-making.
Judges assume that gruesome evidence can influence juror verdicts, but little is known about the manner in which the influence is manifested. In a 2 x 3 study that varied the gruesome content of photographic and verbal evidence, gruesome verbal evidence did not influence mock juror emotional states, and had no impact on the conviction rate. Mock jurors who saw gruesome photographs, compared wit...

متن کاملPhotographs of manipulable objects are named more quickly than the same objects depicted as line-drawings: Evidence that photographs engage embodiment more than line-drawings
Previous research has shown that photographs of manipulable objects (i.e., those that can be grasped for use with one hand) are named more quickly than non-manipulable objects when they have been matched for object familiarity and age of acquisition. The current study tested the hypothesis that the amount of visual detail present in object depictions moderates these "manipulability" effects on ...
متن کاملAre Neuroimages Like Photographs of the Brain?
Images come in many varieties, but for evidential purposes, photographs are privileged. Recent advances in neuroimaging provide us with a new type of image that is used as scientific evidence. Brain images are epistemically compelling, in part because they are liable to be viewed as akin to photographs of brain activity. Here I consider features of photography that underlie the evidential statu...
