An Anthropologist Considers the Single Noongar Judgment

چکیده
1 end of October. But other media outlets which pride themselves on their commitment to the serious discussion of indigenous issues, such as The Australian and the ABC, have presented a succession of laudatory commentaries on the judgment without examining whether Noongar people really had a sound basis for their native title claim. As an anthropologist who gave evidence in the Single Noongar case, I find much that is puzzling, questionable and inconsistent in the reasons Justice Wilcox gave for his decision. And I am genuinely mystified by his statement that, unlike the Yorta Yorta, 'the southwest community did not suffer a cataclysmic event that totally removed them from their traditional country' (S. 599). The Yorta Yorta, like most other Aboriginal groups, suffered greatly as a consequence of European settlement, but there have always been Yorta Yorta people living at various locations within the bounds of their traditional country. 2 Although Justice Wilcox should be commended for incorporating lengthy sections from documents before the Court and from the transcript of evidence into his reasons, a great deal of other relevant material was not included. Unfortunately, much of this material is unavailable to the public, or at best, difficult to access. The anthropological literature on south west Western Australia points to very serious problems with the Wilcox judgment, and given the potential long-term significance of his findings, these need to be brought to public attention.

This article considers the September 11 tragedy as an event that has created a powerful experience-an astonishing and unthinkable "breach" from the expected and routine-that has riveted the American public and provoked personal storytelling. September 11 and its aftermath have provided an occasion for rethinking and reworking cultural identity. We explore how September 11 and subsequent events ...

This paper demonstrates how the nature of a source language document, and the broad goals set for the usability of the content, can direct the process of creating digital language documentation from that source. Gerhardt Laves’s handwritten 1931 field notes on Noongar language and culture of southwestern Australia were retranscribed using an XML markup scheme and processed in various ways using...

The fact that anthropologists ‘construct’ the field in which they conduct their ethnographic research has long been recognized, but less considered are the ways in which the field can ‘construct’ both the anthropologist and fieldwork practices. In many ways this process is a natural corollary of the fact that researchers must always adapt and sensitize themselves to the realities of their field...

This paper considers the problem of minimizing make-span and maximum tardiness simultaneously for scheduling jobs under non-identical job sizes, dynamic job arrivals, incompatible job families, and sequence-dependentfamily setup time on the single batch- processor, where split size of jobs is allowed between batches. At first, a new Mixed Integer Linear Programming (MILP) model is proposed for t...
