Admissibility of Small Scale Digital Devices in U.S. Civil Litigation

Amendments to The Federal Rules of Civil Procedure which went into effect on December 1, 2006 clearly address Electronically Stored Information (”ESI”) and that includes ESI found on small scale digital devices, such as cell phones and Personal Digital Assistants (PDAs). Failure to address ESI on small scale digital devices can lead to spoliation claims when these devices may contain relevant ESI.
