Contracting Officer Workload, Incomplete Contracting, and Contractual Terms

چکیده

This paper examines the effects of an exogenous shift in the cost of contractual completeness induced by workload spikes on the endogenous selection of procurement terms. I conduct an instrumental-variable estimation of the causal effect of workload on contracting. In a sample of 150−thousand contracts from 85 civilian procurement offices over 11 years, increases in contracting officer workload induced by retirements lead to decreased reliance on competitive acquisition procedures, decreased reliance on firmfixed-price contracts, increased risk of renegotiation, and higher total costs of procurement. These estimates are extremely policy-relevant, since the U.S. federal government has experienced exceptional growth in the level of acquisitions contracting over the past decade, but relatively limited growth in acquisitions manpower. The economic consequences of this state of affairs are not well understood, and this paper provides some of the facts necessary to evaluate them. JEL Classification: D23, D86, H11, H57

Legal Status of Pre-Contractual Liability

The discussion about the person's liability for the actions attributable to him before the stage of contracting is a new debate that has been attracted the attention of legal circles. According to this debate, the person’s freedom of contracting does not implement the person’s freedom to ignore the rights and interest of other party. As a result, it would be possible that contracting person con...

Contractual Incompleteness: a Transactional Perspective

Recent scholarship in the field of contract law has concentrated on contractual incompleteness—that is, on the fact that except in the simplest and most basic transactions, contracting parties do not work out all of the relevant details and contingencies of their relationship at the outset. The reasons for incomplete contracts are varied. Sometimes parties deliberately leave terms unresolved, t...

Optimisation of Healthcare Contracts: Tensions Between Standardisation and Innovation; Comment on “Competition in Healthcare: Good, Bad or Ugly?”

An important determinant of health system performance is contracting. Providers often respond to financial incentives, despite the ethical underpinnings of medicine, and payers can craft contracts to influence performance. Yet contracting is highly imperfect in both single-payer and multi-payer health systems. Arguably, in a competitive, multi-payer environment, contractual innovation may occur...

Contractual Incompleteness and the Nature of Market Interactions

We provide experimental evidence that contractual incompleteness, i.e., the absence of third party enforcement of workers’ effort or the quality of the good traded, causes a fundamental change in the nature of market interactions. If contracts are complete the vast majority of trades are initiated by public offers. Most trades take place in one-shot transactions and the contracting parties are ...
