Psychopaths' Morality. Ethicocentrism, Free Will, and the Fear of Decriminalization

چکیده
Present-day legal judgments of psychopathological criminals strongly avoid the exploitation of “moral” considerations. Currently, the attribution of responsibility to criminals often takes advantage of the cognitive concept of mental incapacity so that, in these cases, the moral judgment about moral conducts of “psycho-pathological” criminals is potentially extinguished. We contend that the theories and methods that are currently used in western societies to discharge moral and legal responsibility are not clear in their epistemic structure and so partially unreliable. To support this conclusion we take advantage of our recent cognitive studies concerning the multiplicity of moral frameworks, the gene/cognitive niche co-evolution, and the concept of free will.

Psychopathy is a personality disorder characterized by emotional deficits and a failure to inhibit impulsive behavior and is often subdivided into "primary" and "secondary" psychopathic subtypes. متن کاملMoral Unreason: The Case of Psychopathy
Psychopaths are renowned for their immoral behavior. They are ideal candidates for testing the empirical plausibility of moral theories. Many think the source of their immorality is their emotional deficits. Psychopaths experience no guilt or remorse, feel no empathy, and appear to be perfectly rational. If this is true, sentimentalism is supported over rationalism. Here, I examine the nature o...

While many researchers are still pessimistic about possible treatment methods for individuals with psychopathy, burgeoning research in treatment methodology and neuroscience is beginning to reverse that trend. Broadly construed, the individual with psychopathy suffers from a large constellation of symptoms, each varying by degrees of severity. Psychopathy is primarily associated with aggression...
متن کاملThe Significance of Psychopaths for Ethical and Legal Reasoning
The emerging neuroscience of psychopathy will have several important implications for our attempts to construct an ethical society. In this article we begin by describing the list of criteria by which psychopaths are diagnosed. We then review four competing neuropsychological theories of psychopathic cognition. The first of these models, Newman’s attentional model, locates the problem in a spec...
متن کاملPsychopaths and blame: The argument from content
The recent debate over the moral responsibility of psychopaths has centered on whether, or in what sense, they understand moral requirements. In this paper, I argue that even if they do understand what morality requires, the content of their actions is not of the right kind to justify full-blown blame. I advance two independent justifications of this claim. First, I argue that if the psychopath...
