Whistleblowers or Offenders? A Judicial Approach to Whistleblowing – The LuxLeaks Case

The aim of this article is to study the role judges and their impact on retaliation processes initiated by organisations against whistleblowers. More specifically, we question normative logics used validate or invalidate such processes. To end, cross-check analyse judicial data from LuxLeaks case (2010–2018). Our results firstly enable us establish a relationship between, one hand, interpretative power profile and, other, attitude that may have at end process towards whistleblowers, is, retaliatory actors protective actors. also explain dynamics permeate process. They show can challenge existing legal norms, clarify operationalise others, create new norms regulating ethical behaviour in organisations.
