The Myth of the Lone Judge: Comparing International Judicial Bureaucracies

In “Who Guards the ‘Guardians of System’? The Role Secretariat in WTO Dispute Settlement,” Joost Pauwelyn and Krzysztof Pelc describe, rich detail, pervasive involvement World Trade Organization (WTO) resolution trade disputes. 1 authors conclude, rather emphatically, that “exerts more influence over dispute settlement proceedings than staff any comparable . tribunal.” 2 my view, this conclusion is somewhat misleading, as it portrays “exceptional” or “ sui generis ” 3 among international courts. fact, invisible army legal bureaucrats (clerks, registry secretariat lawyers, arbitral assistants, etc.) plays a “critically important” 4 part across whole field adjudication. What missing comparative analysis power those wield different judicial regimes. Essay, I outline basic framework for comparison, focusing on two main factors: first, organizational contractual arrangements govern relationship judges bureaucrats; second, relative distribution expertise capital between two.
