The crisis in international law and the path forward for international humanitarian law

Abstract This article offers a brief review of the forces that have contributed to contemporary impasse in formation new international law and institutions. It identifies areas where development armed conflict would provide great benefits, yet current conditions render formal legal agreements highly unlikely. then considers how advance desirable projects nonetheless. In absence effective law-making, jurists face choice. One approach, which I call inspirational, is propose idealized systems based on claims justice practicality. Much published work over last decade seems take this path. The hope ideas will inspire thus lead relevant actors adopt at time when obstacles recede. other entrepreneurial describe here, involves leading States acting as “norm entrepreneurs”. They can propound practice adhere norms with intention inducing follow. approach entails State engaging it hopes others emulate, while inspirational an appeal community whole, including significant non-State actors.
