The scientific article analyzes the acute discussion in law enforcement practice and procedural science of problem possibility criminal prosecution a suspect, accused defaming knowingly innocent person commission crime. theoretical basis are works on (both domestic researchers foreign experts). A set general scientific, special philosophical methods knowledge has been used while preparing article, particular dialectical, historical, comparative, dogmatic (formal-logical), system-structural analysis, modeling. It is substantiated that behavior accused, which manifested slandering person, does not constitute right to freedom from self-disclosure. also proved both self-disclosure defense proceedings must have certain limits, particular, it rights interests other subjects protected by law. We stated suspect or should be liable for misleading court pre-trial investigation bodies even if such deception was protect against suspicion (or accusation), avoid liability.
