Territorial Disputes in the Post - Yugoslav Space

This analysis of a sample territorial or border disputes 30 years after the beginning Yugoslavia’s disintegration is informed by pluri-angle analytical framework. With disputes, single reading phenomenon by international law with its established principles and standards peaceful dispute settlement can be insufficient. More often than not, disputes not only relate to sovereignty per se, but also issues nation-building statehood, identity narratives, ontological security, and(perceived) legitimacy as whether ‘just’. In context EU enlargement, the level power (a)symmetry between actors plays role. Looking at case studies (i) Croatia v. Slovenia, (ii) Serbia Croatia, (iii)Serbia Kosovo, this paper demonstrates why States sometimes do comply with conditionality that behaviour State no means irrational, well sustain and/or pose threat settlement law.
