Public–Private Interactions in Privacy Governance

This paper addresses the possible roles of private actors when privacy paradigms are in flux. If traditional “informed consent”-based government-dominated approaches ill-suited to big data ecosystem, can governance fill gap created by state regulation? In reality, how is public–private partnership being implemented protection frameworks? uses cases from APEC’s Cross-Border Privacy Rules (CBPR) and EU’s General Data Protection Regulation (GDPR) as models for exploration. The analysis this demonstrates fluidity interactions across public realms. Self-regulation regulation opposing ends a regulatory continuum, with CBPR-type “collaboration” GDPR-type “coordination” falling somewhere middle. author concludes that there an evident between actors’ potential governing functions their current regimes. Looking future, technological developments market changes call further convergence governance, allowing authority sector simultaneously reshape global norms.
