This article explores the relationship between modern populist movements in America and administrative law by analyzing how features of current contribute to or anti-establishment political movements. The argues that law, like notice comment “hard look” review, have been interpreted through lens a liberal rationalist theory is skeptical democratic control regulatory policy, thereby excludes general public from participation creation politically salient national regulations. commitment this government manifests itself neutral technocratic justifications agencies employ judiciary expects. result pessimistic about ordinary citizens’ ability policy; pessimism provides fodder for politics contributing public’s feelings distrust estrangement federal government. Recent scholarship has paid scant attention law’s movements, even when those take aim at state directly.
