Pawn Paddy Practices According to Islamic Law and Positive Law

This study examines Pawn Paddy Practices according to Islamic Law and Positive Law. The purpose of this was determine the practice pawning rice fields in Sukajaya Village, Jonggol District, Bogor Regency, analyze by people Law, community Regency positive law. research method uses a qualitative approach with type case structured in-depth interviews residents totaling 12 Village. results indicate that sub-district has been going on for long time. In implementation pawning, it is carried out basis mutual trust, where recipient pawn works pawned pawner. There are pawnees who manage themselves some managed third parties, an unspecified time limit. Village not yet accordance law, murtahin manages fields. contains usury muzaroah, namely agricultural product sharing, so there one contract two transactions.
