Muslim women adhering to Minangkabau’s bajapuik tradition in Cirebon, West Java: compromizing a gendered culture in Islamic law

Bajapuik refers to a customary engagement (khiṭbah) of the Minangkabau Pariaman community, where prospective bride’s family gives certain amount money (japuik) groom’s prior marriage. Islamic law allows person give or gifts in process engagement. However, when is revoked and marriage fails, status given during has been much contested. This study aims explore understand positive relationship between bajapuik tradition local traditions. focuses on legal aspects viewed from gender analysis. A descriptive qualitative approach was adopted with primary data obtained through interviews. Data analysis carried out using approach, sociological philosophical approach. concludes that depicts women as having higher position than men. For community Cirebon, annulment an disgrace tradition. An considered legally binding contract. In other words, provisions have coercive power bounded communities. If without valid reason, responsible can be sued for breaking contract compensations. Morevover, dispute occurs over property finances, aggrieved party take action against khiṭbah violators form returning money.
