Legal consequences of train-induced structure borne noise and vibration in residential buildings

Abstract The development of subways in cities has provided great comfort to the citizens, but it brought adverse effects residents buildings adjacent subway lines. main are Structure Borne Noise (SBN) and Vibration (SBV), which identified as environmental challenges. In this research, extent seriousness SBV SBN annoyances people were investigated. This is made two steps; first a thorough field test was evaluate level train-induced noise vibration; then, comprehensive investigation on annoyance from vibration noise, using results obtained interviews questionnaires. indicate that health concerns, economic losses, building damages social harms most important factors, cause citizens. These caused citizens take their complaints judiciary system world. second part effectiveness sufficiency current laws legislation protect citizen against SBV/SBN evaluated. there limitations regard crime determination, criminal identification, estimation rights regarding by SBV/SBN. Also, lack legal awareness among who do not know how get rights. research showed judicial bodies should improve extend make more low-enforcement growing problem need familiar with civil SBV.
