The β-decay scheme of Te138 and the level structure I138 is reported for first time. experiment was performed at Radioactive Isotope Beam Factory RIKEN, as one EUROBALL-RIKEN Cluster Array campaigns. Secondary radioactive ions, including Sb138, were produced by in-flight fission a U238 beam with energy 345 MeV per nucleon. From β decay Te138, supplemented new spin parity assignments, such low-lying negative-parity states positive-parity 1+ state. This state can be interpreted being associated π0h11/2⊗ν0h9/2 partner orbital configuration populated Gamow-Teller transition between neutron in 0h9/2 proton 0h11/2 orbital.
