Entrenching children's participation through UNCRC Incorporation in Scotland

In March 2021, the Scottish Parliament unanimously adopted United Nations Convention on Rights of Child (Incorporation) (Scotland) Bill (Incorporation Bill). This article explores ways in which this law could fulfil children's participation rights Scotland based exercise UNCRC Article 12 coupled with 5, a child's right to be heard line their evolving capacity. It begins by introducing basic concept before constructing as emancipation that is two-dimensional, reflecting both individual and collective dimensions heard. To develop first dimension emancipatory participation, focuses ability engage participate private legal proceedings. The then looks at how views children young people have been included decision-making processes following adoption Children Young People Act 2014, namely gathered through impact assessments. overarching purpose demonstrate direct incorporation can ultimately emancipate from ongoing marginalisation support them become active, engaged citizens.
