Criteria for distinguishing looting from other crimes: A comparative analysis

With the beginning of Russian-Ukrainian war, increasingly often crimes a general criminal nature are instead qualified by Article 432 Criminal Code Ukraine, where composition is entirely different. The purpose this study was comprehensive analysis structure offence looting comparing it with other crimes, as well formulating unified practice understanding and qualification in aspect subject study. According to set study, complex scientific methods used, namely, special ones: method statistical research – analyse compare dynamics committing offences related looting; dialectical within framework investigating theory contradictions incorrect comparative legal context analysing positions scientists regarding essence formal logical when defining category “looting”. It established that need for correct application specified provision conditioned upon such circumstances increase number cases become known from open sources information, which not properly registered investigated law enforcement officers, due lack experience working specificity complexity their registering occupied territories; distinguish crime “looting” under Ukrainian legislation robbing civilians, living quarters, vehicles, shops, infrastructure profit satisfying one’s personal needs. practical significance lies fact main statements conclusions can be used methodological recommendations development an algorithm investigation criminally illegal actions, prescribed also valuable subjects justice activities eliminate misunderstandings different interpretations current revealed practice; considered improving aimed at prevention fight against type crime, making corresponding amendments
