Children’s Rights and Gender Identity: A New Frontier of Children’s Protagonism?

چکیده

This article adopts the concept of protagonismo infantil (children’s protagonism) to argue that children’s voices on gender identity need be centred in order fully empower trans and non-binary children. In this field rights, enables law act as a malleable frontier rather than rigid boundary. Topics concerning sexuality do not feature prominently among legal, social, medical issues most widely discussed terms rights. When they are approached, such topics treated marginal, controversial, divisive. The dominant approach is deny disregard any possibility for self-identification and/or sexual orientation, ‘wait see’ until an older age – some cases, adulthood. Yet every child sexed gendered at birth by legal practitioners parents, core aspects individual’s sense self identity. Focusing mainly United Nations Convention Rights Child (UNCRC), encourages new debate how children can empowered affirm their own through use infantil.
