Berne Convention and Turkey’s Participation Process

چکیده
Bu makalede, bir dönem Lozan Antlaşması ile Türkiye’nin taraf olmayı yükümlendiği edebî, ilmî ve artistik eserlerin korunması hakkındaki Bern Sözleşmesi’ne katılım süreci, dönemin hükûmetine konu hakkında yetki kanununun çıkarıldığı 1952’ye kadar ele alınmıştır. Tercümenin kültürel inşa araçlarından biri olarak kullanıldığı bu süreçte uzun süre boyunca sözleşmeye katılmamasının da cevapları aranmıştır. Anlam ifade etmesi bakımından konunun telif haklarıyla aynı doğrultuda alınması, Türkiye’de yeni hakkı kanunu oluşturmadaki gecikmenin sebepleri arasında Batı uyum Sözleşmesi’nin yeri de incelenmiştir.
