The article analyses the problem of concepts crime and offense definitions, considers legal issues oftheir set facts; based on analysis constitutional, administrative criminal legislation, criteriato differentiate offenses from homogeneous crimes are proposed; scientific views lawyers analysed;legislation improvement post-Soviet republics in delictology proposed.
