Introduction to Some of the Obstacles to Realization of Medical Criminal Justice

The sick person whose disease has been aggravated as a result of medical fault instead of getting cured by doctor and his/her pain has increased needs to be completly supporte.  Including these supports are civil and penal protections. These supports have been almost clearly determined in substantive penal code territory in Iran's legal system but what the sick person gains practically is disappointment in many cases and makes the sick despair of penal justice system (Judiciary), too. The cases that result in uncertainty of penal justice in medical penal code territory are various and numerous. Some of them are related to defective legislation and the others are concerned to interaction of legal authorities with medical authourities involving forensic medicine organization and medical council. In this article by using descriptive analytical method and judicial laws and precedents and existing experts, different judicial authoroties, various procedures, the spirit of legal authorities, dependency and impartiality of authorities and probability of forgery and alteration of the sick's dossier by beneficiaries before or after the sick's complaint or his/her avengers of blood and... that involve these impedimenta have been examined for a better achievement of medical penal justice.
