Analysis of alternative punishments in the light of judicial rulings(Emphasis on free public service penalties)

With the approval of the Islamic Penal Code adopted in 2013, the Iranian legislator introduced some of the community-based punishments into the legal literature of the country which their effectiveness requires the provision of various contexts at different levels of legislation, judiciary and administration.The present article has tried to critique alternative sentencing sentences as a unit of analysis, one of the angles. In this regard, based on the votes issued in the years 1396-97 throughout the country. 450 related votes were extracted and out of these, 210 votes were randomly selected as the sample size. Then, these opinions were analyzed based on the substantive and formal indicators that resulted from holding three focus groups with experts in this field.The data of this analysis indicate that most of the studied samples were defective in at least one of the specified indicators. As a result of the analysis, it can be argued that the observed problems are a function of the lack of the necessary context, including insufficient education and appropriate culture, inflation of cases and lack of sufficient opportunities to address. As a result, without providing the necessary substrates, the existence of defects in the studied indicators will not be unexpected.
